OlympIQ Terms of Service

1. Who We Are and Acceptance of These Terms

OlympIQ is a free educational mobile app that helps students practice for the AMC 10, AMC 12, and AIME mathematics competitions. OlympIQ is operated by Manish Singh from Arizona, United States ("OlympIQ", "we", "us", or "our"). Manish Singh is OlympIQ's operator and the party you are entering into these Terms of Service ("Terms") with.

These Terms govern your access to and use of the OlympIQ app and related services. By creating an account or using OlympIQ, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the app.

2. Eligibility and Minors

OlympIQ is intended for users who are at least 13 years old. When you create an account, we ask for your date of birth, and we do not permit accounts for anyone under 13. By using OlympIQ, you represent that you are at least 13.

If you are under 18 (or the age of majority where you live), you represent that a parent or legal guardian has reviewed these Terms and our Privacy Policy and permits your use of OlympIQ. A parent or guardian who allows a minor to use OlympIQ is responsible for supervising that use and accepts these Terms on the minor's behalf. If you are a parent or guardian and do not want your child to use OlympIQ, please have them stop using it and contact us to delete the account.

3. Your Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Each account is for a single person; you may not share your account or use anyone else's. If you believe your account has been compromised, contact us at olympiqhelp@gmail.com. You may delete your account at any time from the Profile screen in the app.

4. Acceptable Use and Prohibited Content

OlympIQ is a study community for students, and we have a zero-tolerance policy for objectionable content and abusive behavior.

Any text you submit - including your username and any other content you enter - must not contain profane, obscene, vulgar, or sexually explicit language, or any of the content listed below. This applies even to your username.

We may remove any content and suspend or permanently terminate any account that violates these rules, at our discretion and without prior notice.

5. User-Generated Content

You are responsible for the content you submit. By submitting content, you grant OlympIQ a non-exclusive, worldwide, royalty-free license to store, display, and use that content - including through our service providers - solely to operate and provide the app (for example, showing your username on a leaderboard). You represent that you have the right to submit the content and that it complies with these Terms. We are not obligated to store or display any content and may remove it at any time.

6. Reporting and Enforcement

If you encounter objectionable content or abusive behavior, you can report the user directly from their profile in the app (tap Report, choose a reason, and optionally add a short note), or email us at olympiqhelp@gmail.com. We review reports and act on them promptly and consistent with the seriousness of the report - including removing content and, where appropriate, suspending or banning the responsible user. You may also block or remove users using the tools in the app. We reserve the right to take any action we consider appropriate, including removing content, disabling accounts, and cooperating with law enforcement where required by law.

7. Intellectual Property and Competition Content

The practice problems in OlympIQ are past AMC and AIME competition problems, © the Mathematical Association of America (MAA), used under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 (CC BY-NC-SA 4.0) license. All other content, design, and software in OlympIQ belong to OlympIQ or its licensors. Because OlympIQ is free and non-commercial, you may not sell, resell, sublicense, or commercially exploit the app or its content.

8. Copyright Complaints (DMCA)

We respect intellectual property rights. If you believe content in OlympIQ infringes your copyright, send a notice to olympiqhelp@gmail.com that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material you claim is infringing and where it is located in the app; (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act for them. We will remove infringing material and may terminate repeat infringers. If your content is removed and you believe that was a mistake, you may send a counter-notice to the same address.

9. Free, As-Is Service

OlympIQ is provided free of charge, with no ads and no in-app purchases. To the fullest extent permitted by law, the app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, accuracy, fitness for a particular purpose, non-infringement, or uninterrupted or error-free availability. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, OlympIQ and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the app. Because OlympIQ is a free service, our total aggregate liability to you for all claims will not exceed one hundred U.S. dollars (US$100) or the minimum amount required by applicable law, whichever is greater.

Exceptions. Nothing in these Terms limits or excludes liability for: (a) gross negligence, recklessness, or willful misconduct; (b) fraud or fraudulent misrepresentation; (c) death or personal injury caused by our negligence; or (d) any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and this section does not affect any mandatory consumer-protection rights you have.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless OlympIQ and its operator from and against any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of or related to: (a) content you submit; (b) your use of the app; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party. If you are a minor, your parent or guardian is responsible for this obligation. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate with us.

12. Dispute Resolution; Arbitration; Class-Action Waiver

Please read this section carefully - it affects how disputes are resolved and, where enforceable, requires individual arbitration instead of court and limits class actions. Its enforceability varies by jurisdiction and for minors; nothing here waives rights that cannot be waived by law.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at olympiqhelp@gmail.com and give us 30 days to resolve the issue informally.

Binding arbitration. To the fullest extent permitted by law, any dispute that is not resolved informally will be settled by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court.

Class-action and jury waiver. To the fullest extent permitted by law, disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding, and you and we each waive the right to a jury trial.

Opt-out. You may opt out of this arbitration section within 30 days of first accepting these Terms by emailing olympiqhelp@gmail.com with your account email and a statement that you opt out. If you opt out, Section 16 (venue) governs.

13. Termination

You may stop using OlympIQ and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we choose to discontinue the service. Provisions that by their nature should survive - including content licenses, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law - survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of OlympIQ after the changes take effect means you accept the updated Terms.

15. App Store Terms

OlympIQ is distributed through the Apple App Store, and your use is also subject to Apple's Terms of Service and the standard Apple Licensed Application End User License Agreement (LAEULA), which apply in addition to these Terms; if there is a conflict about the licensed application itself, the LAEULA governs. As between you, OlympIQ, and Apple: OlympIQ (not Apple) is solely responsible for the app and its content, for maintenance and support, for addressing any product or intellectual-property claims, and for compliance with applicable law. These Terms are between you and OlympIQ, not with Apple, and Apple has no obligation to furnish support for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list. If OlympIQ is ever offered on Google Play or another platform, that platform's terms will also apply.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona and the United States of America, without regard to conflict-of-laws principles. To the extent a dispute is not subject to arbitration under Section 12, it will be brought exclusively in the state or federal courts located in Arizona, and you consent to their jurisdiction. These Terms do not override any mandatory consumer-protection rights you may have under the laws of your own country of residence, which continue to apply to the extent required.

17. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest of the Terms remain in effect. Waiver. Our failure to enforce a provision is not a waiver of it. Assignment. You may not assign these Terms; we may assign them in connection with a transfer of the service. Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and OlympIQ regarding the app and supersede prior agreements. Force majeure. We are not liable for failures or delays caused by events beyond our reasonable control, including outages of Apple, Google, or other infrastructure providers.
